2015 H-1B Season is Here: Start Early to Avoid the Rush

On April 1, 2015 the US Citizenship and Immigration Service (USCIS) will begin accepting cap-subject H-1B petitions.

H-1B petitions should be filed by April 1, 2015 for an October 1, 2015 start date. Approximately 65,000 cap-subject H-1B visas are available for employees with a bachelor’s degree and an additional 20,000 are available to those who hold at least a US master’s degree from a qualifying public or non-profit university. Last year there were more H-1B visas filed than the allocated number of visas allowed per year. Consequently, not every H-1B petition that was filed was accepted for processing. Due to improvements in the economy in 2014 and the fact that the cap was filled the first part of April last year, it is wise for employers to start preparing H-1Bs now. Beginning April 1, 2015, employers can send petitions to try to get into the H-1B lottery.
